The GI Regulation for craft and industrial products has been published

Italy

Use and reproduction of Italian cultural heritage works: state of the art

With a number close to 50, Italy is by far the country with the highest number of UNESCO world heritage sites.

It is therefore no surprise that in 2004 the Italian legislator enacted the Italian Code of Cultural Heritage (“ICHC”) which defines cultural heritage assets and provides for rules to govern their use and reproduction. Works of a living author whose creations do not go back more than fifty years and creations that are less than seventy years old are excluded from such protection.

Japan

Dr. Martens wins against counterfeit, but the distinctiveness of the “yellow welt stitch” alone is denied

On 9 November 2023, the British footwear company Airwair International Limited (hereinafter “Airwair”), known for its Dr. Martens brand and shoes with yellow welt stitch, won a case at the IP High Court (IP High Court Case No. 2023 (Ne) 10048 (in Japanese)) where they were fighting for an injunction under the Unfair Competition Prevention Act (hereinafter “UCPA”) against a Japanese footwear company MD Planning Co., Ltd. (hereinafter “MDP”).
