Expedited patents in Brazil

For all legal effect, the Industrial Property rights conferred by a patent are considered to be chattels and they afford their owner the right to prevent an unauthorized third party from producing and selling, amongst other commercial activities, the patented object, for twenty years counted from its filing date at the Brazilian Patent and Trademark Office.

Is the remuneration right arising in Brazil?

Brazilian legislators intend to implement in the country its own version of the European publishers’ remuneration right. If the Fake News Bill (Bill No 2,630/2020) become law, internet service providers shall compensate journalistic companies for the use of journalistic content, in the form and based on criteria to be regulated in the future. The gaps in the current wording, however, may have reverse effects of what was initially sought with the measure.

Changes to the Canadian patent rules
