Young AIPPI Members (Virtual) Summit 2022

As AIPPI marks its 125th year celebrations in the year 2022, we are excited to announce the 1st Young AIPPI Members Summit, a virtual gathering of our Young AIPPI Members across the globe, which is scheduled to take place over a half day event on Thursday, 23 June.

AIPPI’s 125th Anniversary Celebration in Belgium

Almost to the day, 125 years after the Constitutive Assembly of AIPPI was held in Brussels on 8 May 1987, the Belgian Group of AIPPI was honoured to launch a jubilee year of celebrations, by hosting a full day hybrid conference on 13 May in Brussels.

Recent changes in Brazil on the remittance of royalties abroad

On December 29, 2021, the Law No. 14,286 was sanctioned, bringing up a significant foreign exchange reform in Brazil. It impacted in a few and relevant aspects for the Brazilian exchange market, foreign capital, and the provision of information to the Brazilian Central Bank (Bacen). The new regulation will come into force next December 30, 2022, and players with operations in Brazil should be aware of relevant changes.
Three-Year review and reform prospect of SPC Intellectual Property Court

"If unsatisfied with this decision, the party may file an appeal brief with this Court, appealing to the Supreme People's Court" – In the past three years, appearances of the parties concerned and legal practitioners of patent cases in China before the bench of the Supreme People's Court ("the SPC") have been far more frequent than before.
'France.com' saga: the French State is entitled to claim the trademarks and domain name on the ground of its prior rights on the name 'France

On 6 April 2022, the French Supreme Court (Court of Cassation) ruled in favour of the French State in a case that has opposed it for many years to the company France.com, Inc. directed by Mr Frydman. The latter was the owner of the domain name "france.com", registered in 1994, and of several "France.com" trademarks registered in 2009 and 2010 (some of which were semi-figurative and included a motif representing the stylised borders of France).
Use of hashtags may constitute trademark infringement in Japan

In Japan, the Osaka District Court has recently held that use of Plaintiff’s brand name as a hashtag constitutes trademark infringement. See the Osaka District Court judgement on September 27, 2021 (#charmantsac Case, Wisteria Kyoto v. P1, 2020(Wa)8061 (in Japanese)).
Important notice concerning deadlines in IP matters before the Ukrainian IPO

At this point in time, it is not yet 100% clear how missing a deadline before the Ukrainian IPO will be treated while martial law is in effect. While waiting for the new Law on Protection of Interests of IP Owners (in Ukraine) during Martial Law to enter into force (the law was recently approved and should soon be signed and published), we wanted to draw your attention to a few relevant points.

Trilateral Seminar of the French, German and Polish Groups

On April 21 and 22, the French, German and Polish groups were finally able to meet in person in Munich! The meeting took place in a framework of traditional trilateral IP seminars of the three groups.

Extra spots for Young Members in AIPPI's Standing Committees
AIPPI is continuously looking at ways to increase the engagement of its membership. In this respect, from now on there will be extra spots for young members in AIPPI's Standing Committees! All Standing Committees will going forward accept an additional member if that member is a young member.

Scan the Globe Webinar Series
Nazli Korkut Ozsoy - First Deputy Secretary General
Scan the Globe is planned as a series of webinars to be started as a part of the AIPPI 125th anniversary activities, which will begin in 2022 with at least two separate webinars and will last into 2023. The purpose is to give AIPPI members access to information about IP laws and practices around the world, especially regarding developments in lesser-known jurisdictions/regions, and share recent litigation cases to show the implementation of the law and where certain decisions made during IP prosecution can affect later enforcement activities.
