2022 Highlights

The end of the year is for a lot of people around the world the time to look back and reflect. What a journey it was in 2022. I would like to focus on some highlights and achievements of AIPPI that all members can be proud of and that make the association stronger than ever.

AIPPI approves a position paper on the WTO Ministerial Decision on the TRIPS Agreement adopted on 17 June 2022

On 12 September 2022, during its World Congress celebrated in San Francisco, CA, the AIPPI Bureau passed a position paper regarding the World Trade Organisation (WTO) Ministerial Decision (MD) on the TRIPS Agreement adopted by the 12th Ministerial Conference of the WTO on 17 June 2022.

The senior leadership of AIPPI at the European Patent Office
The senior leadership of AIPPI and the European Patent Office had last month a fruitful and effective exchange of views on the imminent introduction of the Unitary Patent and Unified Patent Court. The discussion also extended to AIPPI’s immediately preceding and forthcoming resolutions. The dialogue will continue.
AIPPI at the World Intellectual Property Organization
Comprehensive and detailed working sessions between AIPPI and the World Intellectual Property Organization – WIPO in Geneva last month on a range of key IP focus areas including proposed international treaties. AIPPI is excited to continue its productive engagement with WIPO.
AIPPI at the BIP ASIA Forum
AIPPI took part in the 12th BIP Asia Forum in Hong Kong. The theme of the 2-day hybrid event was “Creating New Value, Discovering New Frontiers”. As in previous years, AIPPI co-organised a session on the topic “IP do’s and don’ts on social media”. We would like to thank our speakers for their insightful sharing.
AIPPI at ASIPI’s XXIII Work Sessions and Administrative Council
AIPPI was at ASIPI’s XXIII Work Sessions and Administrative Council last week in Medellin to represent our organisation in this region, foster our collaboration with ASIPI and promote our 2023 AIPPI World Congress in Istanbul.

Members of AIPPI have been appointed to judicial positions in the Unified Patent Court (UPC)

Over 30 individual members of AIPPI have been appointed to judicial positions in the Unified Patent Court (UPC) (see https://www.unified-patent-court.org/en/news/unified-patent-court-judicial-appointments-and-presidium-elections) as either technically or legally qualified judges. AIPPI congratulates its members on their appointments. The development of the UPC is a key milestone in the EU system of IP protection, and complements harmonised EU frameworks on trade marks and designs, providing a more uniform system of patent litigation within the EU. The UPC also makes a valuable contribution towards the protection of innovation, without the need to litigate the same issues in multiple UPC states, thus leading to consistency and a saving of litigation costs.
Redesigned website and enhanced Membership Portal
We launched last month our redesigned website and enhanced Membership Portal. The new website was designed to be easier to navigate, more user-friendly, and to reflect AIPPI’s forward-thinking identity.
We have created a short tutorial video to show all the new features of our Membership Portal.

Canadian Supreme Court confirms record infringement award

On 18 November 2022, the Supreme Court of Canada confirmed the largest patent infringement award in Canadian history in Nova Chemicals Corp. v. Dow Chemical Co., 2022 SCC 43 (“Nova”).
China’s Supreme Court Calls for Anti-monopoly Review on Reverse Payment Settlement in Drug Patent Infringement

In the new ruling of Supreme People's Court (SPC) (2021) S.Ct.IP.Civ.Fin. No. 388, the SPC calls for anti-trust review on reverse payment settlement in drug patent infringement litigation between the brand pharmaceutical manufacturer AstraZeneca and a local generic competitor.
Developments of SEP Cases in China
Guanyang Yao and Xiaoning Yu - Liu, Shen & Associates, China
China is becoming a preferred battlefield for SEP cases worldwide. Since 2020, 4 anti-suit injunction rulings were issued in Huawei v. Conversant, Xiaomi v. IDC, Samsung v. Ericsson and LENOVO v. Nokia cases, and 3 jurisdiction opposition rulings were issued in ZTE v. Conversant, OPPO v. Sharp and OPPO v. Sisvel cases.

The Formstein defence in action in the UK

On 24 August 2022, Nicholas Caddick QC (sitting as a deputy High Court Judge), handed down judgment in Vernacare v. Moulded Fibre Products [2022] EWHC 2197 (IPEC) (Link). The case involved two patents concerned, respectively, with the configuration of open topped moulded fibre wash bowls and their composition.
US Patent Prosecution

After years of declining and/or holding steady, the pendency of US patent applications before being granted as a patent has recently been slowly increasing. This is an important factor to take into account when considering when and how to file patent applications in the US.
